Dear Shire CEO and Councillors
Ref: DA21/136, P52204, TP 128/2021 - Notice of Determination on Application for Development Approval: Additions to Commercial Building and Change of Use – Lot 6 South Western Highway Middlesex.
I hereby request that Councillors be permitted to reconsider the decision that was made at Council Meeting on 20th January 2022.
Had I opted to speak to the matter on that date, there were a number of factors that I believe would have resulted in a different outcome.
I now offer a comprehensive explanation of the situation as it stands :
· Shire of Manjimup failed to give sufficient notice that the item was in the agenda for the Council meeting dated 20 January 2022. Please refer to Shire apology letter Ref: DA21/136, P52204, TP 128/2021.
· Incorrect information was supplied in the Agenda for the Council members 9.5.3.
eg number of buildings within 200m of proposed workshop.
· Provision of additional information to Council for consideration. For example - written permission granted to Lot 6 South Western Highway, Middlesex to run an Earthmoving business from these premises.
· Intent to supply Acoustic Report for Lot 6 South Western Highway, Middlesex.
· Precedents of like businesses in similar circumstances that have received Shire approval to operate as a Depot and Workshop for heavy machinery - eg Dronow Contracting and others, running much larger businesses with residential building much closer in proximity.
I hereby seek approval to appeal the previous decision so that a fair hearing of all the evidence can be tabled in order that Councillors are in a better position to make a fully informed decision.
